7 steps

How buying from abroad works

The usual order of a purchase made from abroad. Each step links to the guide or tool for it.

This is general information, not legal or tax advice; check with a CA or lawyer.

  1. Step 1

    Shortlist from where you are

Narrow the projects down by city, budget, BHK and stage. See where each one is on the map, put two or three side by side, and work out the EMI before anything else.

  2. Step 2

    Take a video site visit

Ask for a live walk on a video call, not a recorded clip: from the project gate to the tower and the actual unit or sample flat, with the approach road and the neighbours in view. Your family in India can join on the same call.

  3. Step 3

    Check the RERA registration

Look the project’s RERA number up on the regulator’s own website — RERA Punjab for Mohali, Zirakpur, Kharar, New Chandigarh and Dera Bassi, Haryana RERA for Panchkula — and match the promoter’s name, the approved project and the completion date.

  4. Step 4

Pay through NRE, NRO or FCNR accounts

Pay through normal banking channels: money sent from abroad, or from your NRE, NRO or FCNR(B) account in India — never in cash or foreign currency notes. Keep the bank’s remittance advice for every payment; you will want it when you sell.

  5. Step 5

Give a power of attorney if you are not travelling

A power of attorney lets someone you trust in India sign for you. It is signed abroad, attested at an Indian embassy or consulate or apostilled (as your country requires), and stamped in India before it is used. Make it specific to the property.

  6. Step 6

    Register the sale deed

You or your attorney sign the sale deed at the Sub-Registrar’s office, with PAN and ID, after paying stamp duty and the registration fee. If the price is ₹50 lakh or more, you as the buyer also deduct 1% TDS from what you pay a resident seller or builder.

  7. Step 7

    Later, when you sell: TDS

When an NRI sells, the buyer must deduct tax at source from the price before paying it, at the rate for a non-resident seller. A CA can apply for a certificate for a lower deduction, and can guide you on taking the money back abroad.

Do I have to travel to India to buy?
Not necessarily. You can see the project on a live video call and sign through a power of attorney: it is signed abroad, attested at an Indian embassy or consulate or apostilled, and stamped in India before your attorney uses it at the Sub-Registrar’s office. What tax is deducted when an NRI later sells the property?
The buyer must deduct tax at source (TDS) from the price before paying an NRI seller, at the rate for a non-resident.
